Customs compliance refers to a business’s responsibility to manage the import and export of goods to and from the UK correctly. While there is no formal checklist for customs compliance, it generally encompasses the practices a business adopts to ensure that duties and taxes are accurately paid, processes are properly controlled, risks are managed effectively, and commercial trade policies are consistently followed.

No – but there are significant advantages in doing so.
Customs compliance and import duty management is a highly specialised area that sits at the intersection of finance, legal, and operations. Everyday micro-decisions can have a major impact on profitability, risk, and your standing with HMRC, yet they are often ungoverned by any single person or department.
Working with a customs compliance consultant who specialises in this field can help join the dots and protect your business from unnecessary customs compliance risks while ensuring that opportunities to reduce or eliminate import and export costs are fully realised.
Maintaining a neutral and impartial view on your customs compliance related decisions can be difficult to do internally. Even businesses with the luxury of a dedicated internal customs compliance manager may look to work with customs compliance consultants to ensure their decision-making is sound and justified.
Therefore, whether you have your own processes for internal customs compliance auditing or not, it is important to consider the different perspectives an external party may have, as the next time your decisions are scrutinised will be under HMRC audit where the cost of error or a difference in opinion is significantly greater.
Should we identify any errors or compliance risks during the delivery of a customs compliance audit, they will be noted and conveyed to the project stakeholders.
All our customs compliance specialists are highly experienced and can provide support and guidance on the best way to resolve any instances of non-compliance in the most effective way possible.
No.
Customs compliance is a global requirement, and our clients need to understand the rules and regulations in both their own country and their customers’ territories. Many core customs standards are set by the World Customs Organization (WCO), and member countries implement these through harmonised frameworks such as the Harmonized System (HS) for tariff classification. Therefore, our scope of support is far greater than just UK customs advice.
If you are facing customs compliance challenges in overseas markets and want to work with a UK-based customs compliance consultant, our team is ready to provide guidance and support.
There are several easy to administer checks all businesses should consider when importing goods.
1. Am I purchasing goods from a preferential country?
Goods originating from preferential countries may be eligible for a preferential rate of duty when imported into the UK. Strict conditions apply, but if met, your business may not need to pay the full rate of import duty when the goods are imported.
2. Are goods being sold within the UK?
If goods are being stored or processed in the UK, but will be consumed outside it, customs special procedures should be considered. These regimes grant importers special permission to suspend or eliminate import duties based on their specific use.
3. How can I determine the customs value of my good?
Customs valuation rules apply in instances where the transaction value can’t be used as the valuation method for customs purposes. In some cases, these rules can be applied strategically to reduce the customs value of the goods and therefore the amount of duty payable.
4. What is the intended purpose of the import?
If goods are being imported for processing, repair, manufacture, sampling or some form of temporary use, customs procedures should be considered to ensure import duty is not paid unnecessarily.
5. Are my goods accurately classified?
The accuracy of the commodity code is essential to ensure the correct tariff is applied. If you aren’t completely confident with the classification of your goods, you may be over or under paying import duty.
If any of these questions haven’t been addressed within your customs compliance strategy, it may be beneficial to consider a customs compliance audit and working with one of BKR’s customs experts.
