Customs Classification: Explained

Professional advice for determining the correct customs classification for imported goods

EXPLAINED

What is a
Customs Classification?

Customs classification is the process of assigning a numerical identification number to a product from the relevant country's customs tariff. In the UK, this is known as the commodity code. Every imported or exported product must be assigned a commodity code.

The commodity code is used for product identification, as well as determination of the applicable import duty rate and several non-tariff measures, such as documentary requirements, licenses, quotas, restrictions and import controls.

Why Is Customs Classification Important To Your Business?

Correctly classifying goods for import or export is a legal obligation of every business and individual who imports and exports.

Duty Optimisation

In instances where more than one code may apply, the correct classification can have a significant monetary impact.

Leaning towards caution may be an appropriate decision on low value imports, but when small percentages matter, a professional review could save your business thousands in unnecessary import duties.

Risk Management

Customs classification is an essential part of importing and exporting, but is inherent with financial, reputational and legal risk.

Ensuring the business has appropriate processes and controls to mitigate classification risk is crucial to remaining both compliant and commercially competitive.

Legal Responsibilities

Correctly classifying goods is ultimately the legal responsibility of anyone who imports and exports goods.

As such, customs classification should viewed in the same regard as finance, where careful consideration is given to staff knowledge, skills and legal decision making.

What Are The Key Challenges?

In some cases, customs classification can be deceptively difficult.

With variances in duty rates, licensing and controls all underpinned by the commodity code, businesses face a monetary, reputational and legal risk when undertaking customs classification.

#1 Complexity

Within the tariff, there are some particularly complex areas to navigate. Equally, there are product types that won’t have a clear fit within the tariff, or may be classifiable under 2 or more headings. Specialist knowledge is often required to come to a safe decision.

#2 Large SKU Ranges

Businesses with a large and diverse range of SKUs may experience challenges allocating the appropriate time to each decision. Maintaining a large database will require a carefully constructed set of process and controls to ensure risk is managed efficiently.

#3 Risk Management

It is common for an importer or exporter to have to make an interpretive decision on the correct customs classification. In these instances, risk is elevated, and businesses should consider mitigation strategies to minimise as much risk as possible.

#4 Maintenance

Classifications are dynamic decisions that require constant maintenance. Changes to the tariff, product specifications or legal rulings may alter the product classification, meaning the correct commodity code today may not be the same in the future.

#5 Time

Determining the correct classification will in some instances require sufficient time to research and contemplate the information available. Without a dedicated compliance function, there may not be the necessary resource available to adequately assess risk and make an informed decision.

Positive Traits of a Compliant Business

Businesses who have implemented optimal classification processes have several common traits:

A rigorous classification process

Processes and controls to capture errors

Regular self-conducted audits

Documented and auditable decision logs

Sufficient training for responsible staff

An awareness of customs classification risk

Key Considerations

Some of the best practises all businesses should adopt within the customs classification strategy:

Auditing

Accurate classification data is meaningless if it is not used within the customs declaration. Best practises should include voluntary checks to ensure the correct commodity code is accessible and being declared by responsible parties.

Controls

The nature of classification mean mistakes will happen. As such, businesses are expected to ensure various levels of controls are in place to capture and correct errors before they manifest.

Processes

Accurate product classification is the output of good practises and processes. A structured approach to data capture, decision making, auditing and error prevention are essential sub-processes.

Knowledge

Customs classification is a specialist skill. Staff members responsible for customs classification should be provided formal training to ensure they have an adequate level of knowledge to undertake such an important responsibility.
