What is a
Inward Processing?


Inward Processing (IP), is a customs special procedure eligible businesses can apply to their local customs authorities for permission to use within their own or third-party processing or manufacturing facilities.

It’s primary use is to suspend the payment of import duties and taxes on imported goods which are intended to be repaired, processed or used in the production of a finished product. This can aid businesses in a number of ways and often allows for import duty to be avoided or reduced.

How Could Inward Processing Benefit Your Business?

There are numerous advantages to operating an Inward Processing regime. Some of the most common reasons are:

Duty Management

Import duties which have been suspended on goods imported under IP are usually not payable on finished goods which are re-exported after processing.

Equally, if the finished goods have a lower rate of duty than the raw materials, goods which are sold within the UK may be subject to the lower duty rate instead.

Repairs & Processing

To be eligible to reclaim import VAT, the importer of record must have ownership of the goods at the time of import. This creates a significant compliance risk for businesses who import goods for repair or processing, but are providing a service on behalf of the owner.

IP can be used to suspend duty and taxes and help manage VAT liability on temporary imports.

UK Manufacturing

Businesses importing materials, parts and components (raw materials) which are used to assemble or manufacture a new product (finished goods) can use IP to suspend import duties and taxes on the raw materials.

The authorisation holder can elect whether duties are payable on the finished goods or raw materials after the production of the goods, creating both a cash-flow benefit and potential duty saving.

What Are The Strategic Uses?

#1 Manufacturing


Businesses importing parts or materials which are used in the production of finished products can use Inward Processing to suspend import duties that would otherwise be payable. If the finished goods are sold outside the UK, import duty on the parts or materials will not be payable.


#2 Duty Inversion


If imported parts or materials are used in the production of a finished product, a business can elect to pay import duty on the goods as they stood pre or post production. If the finished goods have a lower duty rate than the individual parts or materials, this can eliminate or reduce import duties payable if the goods are released to free-circulation.

#3 Repair & Processing


Processors contacted to repair or process goods on behalf of a business based outside the UK may need to temporarily import the goods on behalf of their client. Inward Processing can be used to allow the processor to import the goods for the work to be undertaken, without having to pay import duty and VAT liability on the imported goods.

#4 VAT Liability


Processors who act as the importer of record for their overseas clients are at risk of incurring VAT liability without being eligible to recover it. Inward Processing can be used to suspend and eliminate VAT liability if the goods are re-exported after the work has been completed.

Key Considerations

There are several key considerations for any business thinking of implementing an Inward Processing regime. Some of the key topics our advisors discuss during the scoping phase of the project are:

Record Keeping

A successful application is underpinned by a business’s record keeping practises. Simple operations may be managed in spreadsheets or within an existing WMS. More complex operations may require a more robust solution in the form of a Duty Management System (DMS)

Financial Guarantees

A customs guarantee is a financial security required by HMRC. Since 2021, it is not a mandatory requirement and HMRC will carry out a financial assessment during the application stage to determine if it is necessary to provide one or not.

Equivalence

Equivalence is a simplification within IP which allows commercially interchangeable goods to be treated equally. This is essential for businesses where materials or finished goods are not unique and cannot traceability may be lost during production.

Bills of Discharge

IP authorised parties are required to submit reports each quarter to HMRC detailing their IP activities. As such, an applicant must be able to produce the necessary records and interrogate their data to ensure any discrepancies are addressed.
